An authorized store for Apple goods, iWorld Business Solutions Pvt Ltd (iWorld) in Delhi, has been asked by a consumer forum to make a payment of Rs. 17,400 ($320 approx. at current exchange rate) to a medical student for betraying him by offering him a “substandard iPod”.
The North District Consumer Disputes Redressal Forum stated that iWorld Business Solutions Pvt Ltd (iWorld), a top reseller of Apple items, “practiced fraud” by giving Ankit Singhal, a second-gen iPod by “symbolizing” it as third generation and ordered it to return the payment of the gadget.
The bench controlled by Babu Lal stated, “When the customer demanded third generation iPod, it was duty of the seller to sell only third-generation iPod. In the present case complainant (Ankit Singhal) was sold a second-generation iPod representing it to be a third-generation which is in the nature of deception practiced upon a customer just to sell inferior iPod.”
“The thing sold did not conform to its description. In the circumstances we are of the view that complainant is entitled for refund of amount of iPod. Accordingly, we direct the opposite party (iWorld) to refund the amount of Rs. 12,400, the price of the iPod.”
Ankit Singhal, a pupil of Maulana Azad Medical College in Delhi, had stated that he paid the price for a 3rd gen iPod but the company had given him a 2nd gen product in its place.
Ankit said that the bill offered by the store indicated the iPod as 3rd gen, but afterward when he had inside info, its details on the Apple internet site, he detected it to be second generation.
Singhal stated that despite his requests, the store neither reinstate the iPod nor gave back the amount paid by him.
Singhal also stated that he had bought the iPod for Rs. 12,400 ($225) from the iWorld, as he required it for studies.
